By using this website or our application(s) you also agree to our Privacy Policy.
You may also be bound by the terms of the venue or event organiser that they issue. Please check their website before proceeding.
If you do not accept these terms and conditions please do not use this service.
Definitions
"Terms"- these terms and conditions of Ontapp Tickets set out below:
"Ontapp tickets" (“we”, “our” and “us”)- refers to Ontapp Ltd, a company registered in England and Wales with the registered office at Front Suite, First Floor, 131 High Street, Teddington, Middlesex, United Kingdom, TW11 8HH and the company number 12674131.
"Service" - the online system encompassing the Ontapp ticket website, embedded website in "Event Organiser" sites, and mobile application where tickets are purchased, processed and handled.
"Event Organiser" - the contractual party who uses our service to sell tickets for the Event they organise. They may include but are not limited to event companies, promoters, University societies, performers, or venues.
"Customers" (“you” and “your”) - any user who registers for an account on our website or mobile applications.
"Event" - an event listed by the Event Organiser for which a Customer can purchase a Ticket. Examples include but are not limited to club nights, performances or sporting events.
"Ticket" - proof of right of entry to an Event that is sold by the Event Organiser and purchased by the Customer through our Service.
Your use of our Service
You must be 16 or older to use the Service.
You can only use the service where you have registered to do so.
The Service is free for all Customers but we reserve the right to limit, suspend or terminate your account at any time.
You must abide by all applicable laws.
You must not use the Service to carry out any unlawful activities
You must not (and must not allow anyone else to) access an unauthorised part of the Service, or in any way modify, copy, adapt, or damage any part of the Service.
You must not (and must not allow anyone else to) transmit any potentially destructive technological material to the Service. If you become aware of any unauthorised activity on the Service, you will immediately inform us. We are not responsible for any loss or damage to personal property caused by any digital harmful material.
You will keep your password confidential. If you are made aware of any security breaches relating to your password or the Service, you will immediately inform us.
It is your responsibility to read and agree with the terms and conditions of Event Organisers and/or third parties before purchasing a Ticket. These will be available from the Event Organiser directly on request.
We have no responsibility for your compliance with the terms and conditions of event organisers and/or third parties. If you violate their terms and conditions, you will not be entitled to a refund from us.
We are not responsible or liable to organise/run events. We are not affiliated with and in no way endorse the events on the Service.
Any complaints should be made to the Event Organiser directly.
Use of our platform by Event Organisers
We act as an agent and sell tickets on behalf of Event Organisers, who decide on the price and number of available tickets.
Tickets issued are subject to terms and conditions of the Event Organiser.
It is the event organiser’s responsibility to ensure that all the event details put into the Service are correct.
We are not responsible or affiliated with the content of events on the Service. We are not responsible for any behaviour/actions of the Event Organisers and/or their staff.
If an event is cancelled, it is the event organisers responsibility to inform us.
We reserve the right to remove an event from the site at our discretion.
We reserve the right to withhold fund where we believe the Event Organisers are misusing our Service or using our Service for illegal activities.
Tickets
Once submitted, your order constitutes an offer to us to book a ticket.
We reserve the right to decline the order at our discretion.
When you book tickets through the site, you will receive an e-ticket on your phone, in addition to an email confirmation. If you don’t receive an email confirmation it is your responsibility to contact us to confirm whether or not your order has been placed.
Tickets will be delivered to the account that is linked to the phone number you provide upon registration. It is your responsibility to ensure that these details are correct.
Tickets must be used on the date and time specified
Tickets should not be copied or reproduced without written permission. The Tickets distributed by us still remain the property of the Event Organiser.
Payment
Registration to the Service is free of charge.
Event organisers decide the price of tickets and we apply a booking fee, which is included in the overall price paid by the user.
Payment will be taken via a payment card processing gateway - Mollie.
Prices are subject to change without notice. Tickets that have been confirmed will not be subject to any changes in price.
Ticket Reselling
We reserve the right to charge a service fee when transferring a ticket from one Customer to another.
You are only allowed to resell tickets to events using our Service exclusively. You must not offer your tickets for sale elsewhere.
Event Organisers are in control of the reselling price of tickets. You are not permitted to sell tickets above this value.
We reserve the right to deny access to the Service for customers we suspect are selling tickets above the price set by the Event Organiser.
Third party services and content
Any third party applications from the Service are accessed at your own risk. We are not responsible for any loss or damage caused by third party services.
Your use of any third party applications are subject to their terms and conditions.
Intellectual Property Rights
All intellectual property rights including but not limited to logos, trademarks, photographs, graphics, sounds, text, videos and any other material relating to the Service are owned by Ontapp Ltd or our licensors.
By agreeing to these terms and conditions, you acknowledge that all content is made available to you for your personal use. Use of the Service for commercial purposes, or any other use is strictly prohibited.
These terms and conditions do not constitute the transfer of any intellectual property right from us to any other person or party.
You agree that by submitting any content, information, images or otherwise for publication on the Platform, (“User Generated Content”) you retain any copyright you may have in the User Generated Content, however you grant us and our affiliates a perpetual, irrevocable, worldwide, non-exclusive, royalty-free and fully sub-licensable right and licence to use, reproduce, edit, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such content (in whole or in part) and/or to incorporate it into other works in any form, media or technology, whether for commercial or non-commercial purposes. You waive any moral rights you may have in, or to be identified as the author, of User Generated Content.
You are solely responsible for your User Generated Content (including content you share with other sites, such as social networking sites) and we do not endorse User Generated Content or any opinion, recommendation, or advice expressed therein, and we expressly disclaim any and all liability in connection with User Generated Content.
Privacy and data protection
Your data is processed in accordance with our Privacy Policy.
Limitation of Liability
To the maximum extent permitted by law, we and our relevant Event Organisers shall not be liable for any loss, injury or damage to any person (including you) or property howsoever caused (including by us and/or by the Event Organiser):
in any circumstances where there is no breach of contract or a legal duty of care owed by us or the relevant Event Organiser;
in circumstances where such loss or damage is not directly as a result of any such breach (save for death or personal injury resulting from our or an Event Organiser’s negligence); or
to the extent that any increase in any loss or damage results from your negligence or breach by you of any of the terms of these Terms and/or any other applicable terms and conditions and/or any applicable laws or regulations.
We are not responsible for the actions or failures of any Venue, performer, promoter or other Event Organiser. Under no circumstances shall we be liable for death or personal injury suffered by you or your guests arising out of attendance at an event, unless caused by our negligence. Neither shall we be liable for any loss or damage sustained to your property or belongings, or those of any guests under your booking, attending an Event.
To the maximum extent permitted by law, we and our relevant Event Organisers, shall not be liable for any indirect or consequential losses or loss of data, profits, revenue, earnings, goodwill, reputation, enjoyment or opportunity, or for distress, or any exemplary, special or punitive damages, arising directly or indirectly from your use of th Service and/or any purchases made under these terms. In particular please note that:
personal arrangements and expenditure, including travel, accommodation, hospitality and other costs and expenses incurred by you relating to an event which have been arranged by you are at your own risk, and neither we nor the relevant Event Organisers shall be responsible or liable to you for any wasted or unrecoverable costs or expenditure in relation to such personal arrangements, even if caused as a result of the cancellation, rescheduling or alteration of an event for which you have purchased tickets under these Terms; and
neither we nor any relevant Event Organiser shall be responsible or liable to you for any loss of enjoyment or amenity, including where an event has been cancelled, rescheduled or altered; and
neither we nor any relevant Event Organiser shall be responsible or liable to you (and you will not be entitled to any refund) if admission to a venue or event is refused or revoked at any time as a result of your breach of any Event Organiser’s terms and conditions.
Nothing in these Terms and Conditions seeks to exclude or limit our or any Event Organiser’s liability for death or personal injury caused by our or any Event Organiser’s negligence, fraud or other type of liability which cannot by law be excluded or limited.
Cancellation and refunds policy
You are solely responsible for ensuring that you check to see if an event has been cancelled or moved. We disclaim any responsibility for any expenses incurred as a result of cancellation.
Before purchasing tickets to an Event, you should ensure that you are aware of the refund policy set by the Event Organiser and contact them directly if necessary. Event Organisers may have a “no-refund” policy.
Should the Event Organiser cancel an Event, it is the Event Organiser’s responsibility to inform Ontapp and the Users who purchased Tickets. In such circumstance, the Event Organiser shall refund all Ticket sales in accordance with these Terms and is responsible for processing refunds using the Service, or contacting Users regarding an alternative date or substitute Offer.
Refunds are at the sole discretion of the Event Organiser.
Refunds cna only processed where the Event Organiser has given us permission to do so and they have suffiient funds held on their account.
If an Event Organiser has insufficient funds on account your should contact them directly to claim a refund.
Booking fees and administration costs will not be refunded under any circumstances.
If you attempt to obtain a refund via your bank and there is no legitmate reason for doing so, we reserve the rihgt ot reclaim the full price ofr Tickets purchased and booking fees, plus any additional costs incurred by you cancelling the transaction. This may include but is not limited to chargebacks or other dispute fees levied by out payment gateway.
Force Majeure
In the event of an extraordinary circumstance that is reasonably beyond our control, including but not limited to war, natural disasters, terrorsim, pandemics, embargos, or strikes, we shall not be responsible for any delay in, or inability to provide the Service.
Indemnification
The Event Organiser shall indemnify Ontapp Ltd if a claim is made against us resulting from loss or damage as a result of incorrect information provided by the Event Organiser.
The Event Organiser shall indemnify Ontapp Ltd if a claim is made against us by a Customer regarding an event itself.
Termination
You are under no obligation to use the Service and have the right to stop using it at any time.
Applicable Law
These Terms will be governed by the laws of England and Wales. All parties agree to submit to the exclusive jurisdiction of the courts of England and Wales in relation to any dispute arising.
Changes
We reserve the right to make changes to our terms from time to time. It is your responsibility to review these Terms from time to time to check if they have been amended.
